Terms and Conditions

  

 Lake Side Ranch & Wetumka Equine Rescue & Education Foundation

These Terms and Conditions (“Terms”) govern the use of property, services, programs, events, facilities, and activities provided by Lake Side Ranch and Wetumka Equine Rescue & Education Foundation (collectively referred to as “the Organizations,” “we,” “us,” or “our”).

By entering the premises, participating in any activity, making a reservation, donation, or using our services, you acknowledge that you have read, understood, and agree to these Terms.

1. ASSUMPTION OF RISK

Equine activities are inherently dangerous. Risks include, but are not limited to:

  • Kicks, bites, falls, collisions
     
  • Equipment failure
     
  • Uneven terrain
     
  • Weather conditions
     
  • Unpredictable behavior of horses or livestock
     

By participating in any ranch, rescue, educational, volunteer, lesson, trail riding, event, or visitation activity, you voluntarily assume all risks, known and unknown, including serious injury or death.

2. LIABILITY WAIVER & RELEASE

To the fullest extent permitted by Oklahoma law, participants, guests, volunteers, donors, and visitors agree to release, waive, and hold harmless Lake Side Ranch and Wetumka Equine Rescue & Education Foundation, including owners, officers, employees, volunteers, contractors, and agents, from any and all claims, demands, injuries, damages, or losses arising from participation or presence on the property.

This applies to:

  • Riding lessons and trail rides
     
  • Educational programs
     
  • Volunteer work
     
  • Tours and events
     
  • Animal handling or observation
     
  • Use of facilities and equipment
     

3. MINORS

All minors must be supervised by a parent or legal guardian at all times unless otherwise authorized in writing. A parent or legal guardian must sign all waivers for minors. The supervising adult assumes full responsibility for the minor’s conduct and safety.

4. SAFETY RULES & CONDUCT

All participants and visitors must:

  • Follow instructions from staff and volunteers
     
  • Treat animals humanely and respectfully
     
  • Wear appropriate footwear and safety gear
     
  • Refrain from reckless, abusive, or disruptive behavior
     

We reserve the right to remove any person from the property for unsafe or inappropriate conduct without refund.

5. ANIMAL WELFARE & INTERACTION

All horses and animals—especially rescue animals—may have unknown histories, medical conditions, or behavioral sensitivities.

  • No feeding, handling, or riding animals without permission
     
  • No chasing, teasing, or harassing animals
     
  • Rescue animals may not be suitable for public interaction or riding
     

Failure to follow animal welfare rules may result in immediate removal.

6. RESERVATIONS, PAYMENTS & REFUNDS

  • All reservations, lessons, events, or rentals are subject to availability
     
  • Payments may be required in advance
     
  • No refunds due to weather, no-shows, early departures, or rule violations
     
  • Activities may be canceled or modified for safety or animal welfare reasons
     

7. DONATIONS & NONPROFIT NOTICE

Wetumka Equine Rescue & Education Foundation is a 501(c)(3) nonprofit organization.

  • Donations are voluntary and non-refundable
     
  • Donation receipts will be provided upon request
     
  • Donations do not guarantee services, adoption approval, or special access
     

8. VOLUNTEERS

Volunteers participate at their own risk and must sign all required waivers. Volunteers agree to follow rescue protocols, safety guidelines, and confidentiality rules. We reserve the right to terminate volunteer participation at any time.

9. MEDIA RELEASE

By entering the property or participating in activities, you grant permission for photographs and video recordings to be used for promotional, educational, and fundraising purposes unless you provide written notice otherwise.

10. PROPERTY DAMAGE & PERSONAL BELONGINGS

Participants are responsible for any damage they cause to property, equipment, animals, or facilities. We are not responsible for lost, stolen, or damaged personal items.

11. HEALTH & MEDICAL

Participants are responsible for their own medical insurance and expenses. In the event of an emergency, we may seek medical assistance at your expense.

12. GOVERNING LAW

These Terms are governed by the laws of the State of Oklahoma. Any legal action shall be filed in the appropriate court within Oklahoma.

13. SEVERABILITY

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14. ACCEPTANCE OF TERMS

By entering the premises, booking services, volunteering, donating, or participating in any activity, you acknowledge that you agree to and accept these Terms and Conditions in full.


 

🐎 OKLAHOMA EQUINE ACTIVITY LIABILITY ACT NOTICE

Under Oklahoma law, an equine activity sponsor or equine professional is not liable for injury to or death of a participant resulting from the inherent risks of equine activities, pursuant to the Oklahoma Equine Activity Liability Act (51 O.S. §155.1 – §155.5).  

  
 

Return and Refund Policy

  

Lake Side Ranch & Wetumka Equine Rescue & Education Foundation

This Refund & Cancellation Policy applies to all lessons, trail rides, programs, and activities offered by Lake Side Ranch and Wetumka Equine Rescue & Education Foundation.

⏰ CANCELLATIONS & REFUNDS

  • A minimum of 48 hours’ notice is required to cancel or reschedule an appointment in order to receive a refund.
     
  • Cancellations made less than 48 hours before the scheduled activity are non-refundable.
     
  • No-shows are non-refundable and non-transferable.
     

🌦 WEATHER POLICY (RAIN, SNOW, OR SHINE)

All lessons and trail rides are conducted rain, snow, or shine.

We DO NOT cancel due to:

  • Rain
     
  • Cold temperatures
     
  • Heat
     
  • Snow (when safe conditions exist)
     

❗ WEATHER CONDITIONS THAT MAY RESULT IN CANCELLATION

Activities will only be canceled by us in the event of:

  • Lightning
     
  • Tornado warnings
     
  • Other severe or unsafe weather conditions at our discretion
     

If we cancel due to unsafe weather, participants will be offered:

  • A reschedule, or
     
  • A refund
     

🐎 SAFETY & OPERATIONAL CANCELLATIONS

We reserve the right to cancel or modify activities due to:

  • Horse or animal welfare concerns
     
  • Safety issues
     
  • Unforeseen operational circumstances
     

In such cases, a reschedule or refund will be offered.

💳 REFUND METHOD

  • Approved refunds will be issued to the original form of payment.
     
  • Processing times may vary depending on payment provider.
     

✅ AGREEMENT

By booking, participating, or making payment, you acknowledge that you have read, understand, and agree to this Refund & Cancellation Policy.
